Hello, Kindly provide me with the following information requested under the purview of the Right to Information Act, 2005. SUBJECT MATTER: Concerns of the matter are related to the Presidential Notification which depicts that Rabari community of Gir, Barada & Aalech who were residing in the Nes prior to 1956 should be treated as Scheduled Tribe (ST). Then after Adijati department has passed on various circular in the form of Government Resolution (GR) to help the Rabari community in availing the ST benefit and make things simple for e.g. survey carried out by Malkan Committee, Various GR, and High court judgment and so on. In this RTI application, I have narrowed down my query only to Rabari families of Gir Forest of Junagadh district. I believe that 1956 Presidential notification is applicable to mainly two types of Rabari families. (A) Rabari families who have been migrated from the Nes of Gir Forest of Junagadh district (B) Rabari families who still exist (as on date) in the Nes of Gir Forest of Junagadh district. B types of Rabari families are highly illiterate, underprivileged & ignorant to law and do not have easy access to Judicial mechanism. To sort out this issue, I am thankful to Adijati department for all his effort to facilitate hassle free issuance of ST certificate to Rabari families by circulating various GR and few GR purely targeting to the B facet of the community who still exist (as on date) in the Nes. I believe that there is GR insisting of giving ST benefit to B type of families purely based on site survey and photography of the Nes of Gir Forest of the region. Unfortunately, none of the Mamlatdar and Taluka Schedule Tribe committee practices the above GR positively. Hence, It is a sincere request hereby to Honorable Adijati Commissioner Gandhinagar to look into the details of the matter. The information sought hereby from the Adijati Commissioner Gandhinagar due to feeling of apathy caused by Mamlatdar and Taluka Schedule Tribe Committee. INFORMATION SOUGHT Q1: Please provide a copy of GR which reveals the benefit of Schedule Tribe (ST) treatment purely based on Forest site survey & Nes photography (Gir Forest) of the illiterate Rabari families currently residing (as on date) in the Nes of Junagadh Gir Forest Sanctuary region of Gujarat state. Q2: Please provide a time frame to avail the ST certificate for the Rabari families currently residing in the Nes region of Junagadh Gir Forest of Gujarat state from the date of application to Mamlatdar of his present residence. Please find the application fee for the request attached with this application. Upon the receipt of an information request, a PIO shall provide the information and in the form as it is asked in above question. This information should be provided as expeditiously as possible and in any case within the thirty (30) days of the receipt of the request. If you do not provide the information in the form as it is asked can be considered as application rejected or if you feel that above requested information does not pertain to your department than please follow the provision of section 6(3) of the RTI Act, 2005 and please provide the details (Name & Designation) of the first appellate authority w.r.t. your department with the reply to the above request, where I may if required file my first appeal.
