In response to my post 'Strange but True', one blogger from Secunderabad responded on 'RTI INDIA' website as follows:

"That Public Authority seems to have appointed SPIO andSAPIO in each and every section.

The ideal would be if a citizen knows which is the relevantSPIO . But, as you yourself mention, how will a ordinary citizen ever know, who is the correct SPIO ?

For that purpose, the best is to address the RTI Application to any "SPIO" with the correct designation and address. Let him then get the correct/relevant/respectiveSPIO to provide theinformation .

The other way would be, specially if you are going to file frequent RTI 's to this PA, to check the Sec 4 disclosure of the PA. There, they have to disclose the "functions, duties, responsibilities" of each officer. Once you know the function, then you know who is the correct PIO .

You can do one more thing, file a RTI with the serial No. 111 and ask for:

1. Index of all records held by the PA
2. Catalogue of all records held by the PA
3. Which SPIO is responsible for answering RTI applications for which subject."

This prompts me to go ahead with a series of 'STRANGE BUT TRUE' -real events in West Bengal in respect of RTI Act. Hence this 'Strange but True-3';

Thanks for the response from Secunderabad. But Sir, things are a bit different in West Bengal.. I am uploading herewith photocopies of the envelope with postal marks and scriptures where you shall find written 'Insufficient address' because the addressee was SPIO , O/O the District Magistrate, Paschim Medinipur. P.O. Midnapore; PIN-721101. The letter reaches Midnapore.. as it can be seen from Postal Cancellation Stamp but fails to find the SPIO in the Office of the District Magistrate.

Next, I am uploading a rejection letter from SPIO , F&S department, Govt of WB. As many as six applications of different dates are rejected with a single stroke, in a single letter under single sub-section 8.(1) (h) of RTI Act, 2005 with fabricated allegations.

Now, kindly check the High Court Rulings on this sub-section proudly displayed on CIC website www.cic.gov.in/ High Court Rulings;

Can you find any consonance with actions and the Rules... Or

Please check the Full bench decisions of the CIC on this sub-section 8.1.h in Appeal No.CIC/MA /A /2008/1233/AD. Dated 5 August 2008..

Don't you have a feeling that West Bengal is a state outside Indian territory following entirely different norms..

You will certainly say.. Go for first stage Appeal and then Second Stage Appeal before the WBIC. Well, Sir! That has also been tried..

One of these prayers rejected by the SPIO was about information regarding my salary, reasons of non-payment of annual increments or higher scales etc. without any order or record .. The CIC of WBIC said; it is not an information at all.. He said information is something that exists on record .. Now please tell me from where I shall find the records for withholding of my legitimate dues whimsically without keeping anything on record . Yes records/ orders are required for granting benefits.. for withholding or non-granting, one may not go on records...
