The subject matter is based on 1956 Presidential Notification of Government of India which reveals that Rabari community of Gir; Barda & Aalech who are/were resident of Nes region of forest department prior to 1956 are treated as Schedule Tribe (ST) Rabari families. Herein this RTI application, information has narrowed down to focus on information related to the Rabari families of Gir Forest of Junagadh district of Gujarat state.
Unfortunately, disparity can be seen in the hugeness of the expectation and smallness of the reality in the information circulated through Government Resolution (GRs) based on the Presidential Notification, though it was an effort to resolve the matter. It is a sincere request to honorable Adijati Commissioner Gandhinagar to look into the intricacies and practicality of the matter. In an effort to provide assistance by facilitating a helping hand from higher level judicial mechanism to this underprivileged Rabari community which is Right & duty of Citizen of India, I request Adijati Commissioner Gandhinagar to facilitate a Certified copy of all the GRs pertaining to Schedule Tribe benefit of the Rabari community based on 1956 presidential notification in English language which is declared as one of the official language of the Government of India.
Q1: Please provide me certified copy of all the Government Resolutions (preferably in English language) pertaining to the Rabari community describing the benefit of Schedule Tribe (ST) treatment based on 1956 Presidential Notification of Government of India.
DETAILS OF THE SUBJECT MATTER:
It is always seen that illiterate and underprivileged community are harassed by asking irrelevant query or by asking to submit documents such as Maswadi Receipt or any other piece of paper which can prove their claim of residence prior to 1956 in Nes of Gir forest. It is ridiculous to expect any piece of paper from illiterate people and even worst to expect them to have a safe keeping of such records for more than 50 years (normally, during this period, more than three generations have been passed by in this community) which is even not available with Government or Forest department to verify with. How public authority can expect from such an underprivileged Rabari families to show records prior to 1956 in spite of the fact that even they doesn’t have any of such records with them to cross verify?
There is a feeling of grievance among the Rabari community caused by frequent denial of issuance of ST certificate by Mamlatdar & Taluka Schedule Tribe Committee. It is always felt that Mamlatdar & Taluka Schedule Tribe committee shows apathy in to the matter and do not follow the “Government Resolution (GRs)” & “Vigat Darshak Card issued by Government based on the investigation carried out by Malkan Committee” which can be seen from the frequent refusal by Mamlatdar & Taluka Schedule Tribe committee to issue a cast certificate. Whereas the same case when sought a justice from high court, honorable justice of high court had quashed the numerous order of refusal by Mamlatdar. Having said this, I would like to request honorable Adijati commissioner to verify the statistic from records; the honor will realize that this is not the exaggeration of the issue but purely ground reality. Unfortunately very few individuals from this underprivileged community could have an excess to higher level judicial mechanism. Hence through this noble effort, judicial help will be sought after availing the information in the form (English) as it asked in above question.
